Final Decision of the CT Board of Examiners in reference to CDL/DOT Exams reflects very positively for Chiropractors in Connecticut

I am very excited to be able to share with membership the results of us petitioning the Connecticut Board of Examiners. The purpose of this action was to clarify that our scope of practice, in the state of Connecticut, permits us to continue to perform CDL/DOT examinations.
Historically, on August 13, 2013, the State of Connecticut, Department of Public Health had responded to an inquiry by the US Department of Transportation. It was deemed by a public health employee that our scope of practice was not sufficient to meet the requirements for the CDL/DOT physical examination process. At that point our ability to perform CDL examinations would have been terminated. The CCA challenged that opinion and we brought our concerns to the Ct State Board of Chiropractic Examiners.
A public hearing was called. The CCA and our legal representative Attorney Mary Alice Moore-Leonhardt presented over 425 pages of legal documents to prove our point. We brought in representatives from the CCA and a number of colleges to further cement the validity of our position. Hours of testimony made it crystal clear that not only are we educated to perform the CDL examination and we are clinically competent to do so!
This is a very important decision. The final result outlines very specifically that we are trained physicians capable of performing CDL/DOT examinations. I think that when you have the opportunity to review the document you will be very pleased. This document will be a part of our discussion at the upcoming mid-year membership meeting next Thursday, April 30th at the Crowne Plaza in Cromwell. The meeting will begin promptly at 1:15 p.m. I hope you are able to join us.

Commission Approves Final Consent Orders in Matters of Connecticut Chiropractic Association
Following a public comment period, the Commission has approved the issuance of a final consent order in the matter concerning the Connecticut Chiropractic Association (CCA), the Connecticut Chiropractic Council (CCC), and Robert L. Hirtle (CCA’s legal counsel). The vote to approve the final order was 4-0. (FTC File No. 071-0074; the staff contact is Robert Canterman, Bureau of Competition, 202-326-2701; see press release dated March 5, 2008.)

The Connecticut Chiropractic Association has entered into a Stipulated Judgment and Release with the Office of the Attorney General of Connecticut.
The Connecticut Chiropractic Association (“CCA”) has entered into a Stipulated Judgment and Release (the “Judgment”) with the Office of the Attorney General of Connecticut (“OAG”) to settle allegations that the CCA, acting in combination with the Connecticut Chiropractic Council (“CCC”) and Robert L. Hirtle (“Hirtle”), violated the antitrust laws by, among other things, conspiring to fix or increase prices paid for chiropractic services and to boycott third-party payers. The CCA has expressly denied those allegations and has made no admission of liability or wrongdoing. As part of the Judgment, the CCA is required to notify each of its officers and directors, its agents, representatives and employees who have responsibilities with respect to the subject matter of the Judgment, its members, and third party payers of the Judgment, and to provide each such person a copy of the Judgment and the Complaint in this matter.
